User: "User" or "You" or "“Your" refers to you, as a user of the Services. A user is someone who accesses or uses the Services for the purpose of hosting, publishing, transacting, sharing, displaying or uploading information or views or pictures and includes other persons jointly participating in using the Services, including, without limitation, a user having access to “de’HoFoo business page' to manage claimed Home Chef listings or otherwise.
Content:"Content" will include (but is not limited to) reviews, images, photos, audio, video, location data, nearby places, and all other forms of information or data.
"Your content" or "User Content" means content that you upload, share or transmit to, through or in connection with the Services, such as likes, ratings, reviews, images, photos, messages, profile information, and any other materials that you publicly display or displayed in your account profile.
"Third Party Content" means content that comes from parties other than de’HoFoo or its users and is available on the Services.
"de’HoFoo Content" means content that “de’HoFoo” creates and make available in connection with the Services including, but not limited to, graphics, design, compilation, computer code, products, software, visual interfaces, interactive features, aggregate ratings, reports and other usage-related data in connection with activities associated with your account and all other elements and components of the Services excluding Your Content and Third Party Content.
JISHNEM Innovations Pvt. Ltd. (hereinafter referred to as "de’HoFoo ", “company”, "we", "us", or "our") provides an online marketplace / App for handheld devices that connects Home Chefs or Others who want to provide Food Services or Otherwise to users looking for home cooked meals Or Other.
Thank you for using the de’HoFoo platform. These Terms and conditions are intended to make you aware of your legal rights and responsibilities with respect to your access and use of the de’HoFoo platform and/or website at ‘www.dehofoo.com’ and any related mobile application or software.
Please read these Terms carefully. By accessing or using the de’HoFoo platform Services, you are agreeing to these “terms and conditions” and are entering into a legally binding contract with the de’HoFoo platform Services. Any person who accesses this de’HoFoo platform Service is presumed to be legally capable of entering into a legal binding contract and has understood and voluntarily accepted the Terms. You may not use the services if you do not accept the Terms or are unable to be bound by the Terms & Conditions.
You hereby represent and warrant that you are at least eighteen (18) years of age or above and are fully able and competent to understand and agree the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms. You further declare that you are in compliance with all laws and regulations in the locality/state/country in which you live when you access and use the Services. You agree to use the Services only in compliance with these Terms and applicable law, and in a manner that does not violate our legal rights or those of any third party(ies).
We may vary or amend or change or update these Terms & Conditions, from time to time entirely on own discretion. Your use of Platform after any such amendment or change in the Terms shall be deemed as your express acceptance to such amended/changed terms and you also agree to be bound by such changed/amended Terms & Conditions. You shall be responsible for checking these Terms & Conditions from time to time and ensure continued compliance with these Terms.
In order to access the Site and to Order Food Online or to register yourself as a Foodie, you must register yourself by creating an account on our Website or Mobile Application (“de’HoFoo Platform Account”) by accepting all the Terms and Conditions to become a user. You may register to join the Services directly via the Website or Mobile Application.In order to register as a Home Chef / Service / Food Provider, you must create an account (‘Home Chef Account’) by accepting all the Terms and Conditions and comply with the guidelines to become a registered Home Chef. You may register to join the Services directly via Website or Mobile Application. It is mandatory for a home chef to have complied with FSSAI Registration and Other Legal & Regulatory Requirements from time to time which are being in force. Same shall be Updated and if the same is not complied with the Home Chef / Service / Food Provider will be liable for Penalty and Fines as may be deemed fit by the Company or Its Management.
The de’HoFoo platform shall facilitate the Foodie to order Food online from Home Chefs by using the de’HoFoo platform App Service. You acknowledge and agree that you have complete responsibility for all information, pictures and material that you add while using the de’HoFoo platform App. The User’s discretion is required while using the de’HoFoo platform Service.
The de’HoFoo platform Service shall be used solely for User’s exclusive, non-assignable, non-transferable and limited personal use and for no other purposes. The User’s Use of the de’HoFoo platform Service is subject to all applicable Laws & Regulations as may be imposed by the Central Government / State Government or Local Authority from time to time wherever applicable. Except as specifically permitted in Terms, User shall have no right to copy, change, alter, amend, reverse translate, publish, disclose, display or make available, or in any other manner, decode the de’HoFoo platform App and/or the Website.
We are a Platform aggregator, providing you with an online platform to order food from our list of Home Chefs available on the de’HoFoo Platform.
Our responsibilities are limited to :
(i) facilitating the availability of services; and
(ii) serving you, the user/foodie, as a limited agent of each Home Chef for the purpose of accepting payment from you for your online order.
Goods and services purchased from the de’HoFoo Platform is for your personal use only and you agree that the same are not for resale or you are not acting as an agent for the parties. JISHNEM Innovations Private Limited Or Its Management or Employees does not take any responsibility or warranty of the item-specifics (legal title, creditworthiness, identity, etc.) of any Home Chef/Foodie. You are advised to use your best judgment in this behalf. We serve as a link between Foodie and the Home Chef’s and thereby do not take any additional responsibility whatsoever that does not fall into our business process.
Some of the Services are/may be supported by advertising revenue and may display advertisements and promotions. These advertisements may be targeted to the content of information stored on the platform, queries made through the platform or other information. The manner, mode and extent of advertising on the platform are subject to change without specific notice to you. You agree that de’HoFoo may place such advertising on the platform.
Part of the platform may contain advertising information or promotional material or other material submitted to de’HoFoo by third parties or Users. Responsibility for ensuring that material submitted for inclusion on the Platform or mobile apps complies with applicable international and national law is exclusively on the party providing the information/material. Your correspondence or business dealings with, or participation in promotions of, advertisers through the Platform, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, shall be solely between you and such advertiser. de’HoFoo ( Also Known as JISHNEM Innovations Private Limited) will not be responsible or liable for any error or omission, inaccuracy in advertising material or any loss or damage of any sort incurred as a result of any such dealings or as a result of the presence of such other advertiser(s) on the Platform and mobile application.
The Application and Services may contain links to third-party websites or resources.
You acknowledge and agree that de’HoFoo is not responsible or liable for:
(i) the availability or accuracy of such websites or resources or
(ii) the content, products, or services on or available from such websites or resources.
Links to such websites or resources do not imply any endorsement by de’HoFoo of such websites or resources or the content, products, or services available from such websites or resources.
You agree that any contract for the Food ordered through the use of de’HoFoo platform App is between You, Foodie, and the Home Chef or Other any contract for the supply of de’HoFoo platform Service from the de’HoFoo platform App and/or Website is between You and Home Chef. You agree to take reasonable care while providing with your details and warrant that these details are accurate and complete at the time of using the service. You also warrant that the credit or debit card details that you provide are your own credit or debit card and/or that you are authorized to use the card(s). Any Fraud or Error is not our responsibility and same shall not be held against the Company or Its Management.
“User” understands that some type of Food may be suitable for Users within certain age ranges only. It is your sole responsibility to check whether the Food you are ordering is suitable for the intended recipient.
The user of the de’HoFoo platform app while ordering food shall make sure that the food ordered by him/her does not contain any allergens or any allergy-causing ingredient specific to him/her. JISHNEM Innovations Pvt. Ltd.(de’HoFoo platform) shall not be responsible for the food ordered by the user/foodie of the app when the user has not taken precaution in specifying his allergy/allergen while placing his order. The customer shall take utmost care in placing the order and shall contact the “Home Chef” regarding the menu item he/she intends to order and its ingredients and shall make sure nothing in the menu item shall act as an allergen to the consumer. The “OWNER i.e. platform” of the app shall at no point of time be held responsible for any allergic reaction caused to the consumer. It is the sole responsibility of the user to check for such information in the website and place orders accordingly.
If Home Chef / Service / Food Provider, found bypassing de’Hofoo platform and dealing with Foodie (registered at de’HoFoo platform) directly, will be delisted from de’Hofoo platform on immediate basis and will be liable for Penalty and Fines as may be deemed fit by the Company or Its Management.
Cancellation request for food delivery will not be processed for any particular day after the Order Closing time decided by Home Chef. It is the sole responsibility of the user to check for such information to place orders accordingly. Home Chef reserves the right to alter the order closing time and such modified order closing time will be immediately applicable therefrom. Whereas all orders placed through use of de’HoFoo platform App will be subject to the individual contracts between the Foodie, Home Chef and the de’HoFoo platform Service.
All prices listed on the de’HoFoo App for Food is correct at the time of publication. While de’HoFoo takes great care to keep them up to date, de’HoFoo reserves the right to alter the menu of Food available for sale on the de’HoFoo App, the price of Food. The user agrees that in case of change in price, de’HoFoo or its employees will not be liable to him in any manner. The total price for Food including all other charges, taxes, costs, if any, will be displayed on the de’HoFoo platform App when you place your order.
The invoice for any purchases will be made by Home Chef in the name of customer and all the payments shall be collected by de’HoFoo. Same will be settled weekly/bi-weekly basis after deduction of the commission and other miscellaneous charges for all the orders successfully completed by de’HoFoo. These charges will be communicated to Home Chef separately. The charges may vary from time to time, which will be communicated separately.
Currently de’HoFoo has not started managing food delivery. If Home Chef is ready to deliver food, Home Chef will take reasonable care to deliver food package in a timely manner. No responsibility is taken for late delivery by de’HoFoo. In case of late delivery, the delivery charge will neither be voided nor refunded by de’HoFoo. All risk in the Food and Food Delivery shall pass to you upon delivery. If you fail to accept delivery of Food, at the specified time or the Home Chef is unable to deliver at the specified time due to your failure in providing appropriate instructions or authorizations, then the order shall be deemed to have been delivered to you and all risk and responsibility in relation to such Food shall pass to you. Any storage and other costs which Home Chef incurs as a result and consequence of the inability to deliver shall be yours to bear and you shall indemnify home chef in full for such cost. You must ensure that at the time of delivery of food adequate arrangements, including access where necessary, are in place for the safe delivery of the Food. It might not be possible for a home chef to deliver to some locations. In such cases, the home chef will inform you accordingly and arrange for cancellation of the order or deliver to any alternative delivery address or for you to pick up the food order yourself or make arrangements for the same.
In preparing your order, home chef aims:
(i) to allow you to pick the order yourself from the home chef location.
(ii) to deliver the Food at the place of delivery requested by you in your order.
(iii) to deliver within the time confirmed by the home chef.
(iv) to inform you if the home chef expects that he / she will be unable to meet the estimated delivery.
You understand and accept that JISHNEM Innovations Pvt. Ltd. is an organization that links the Home Chefs and you (the Foodie) and does not take any responsibility that does not comply with our business.
If home chef has not opted to deliver food on de’HoFoo app, you will have to reach the specified location at the time that has been stated after you receive the confirmation from the home chef that your food is ready to be picked up. You understand and agree that the responsibility in case of occurrence of unforeseen incidents like theft, physical harassment, abuse, or any other unfortunate incident, from either parties (Home Chef and the Foodie) will lie completely on both the parties. The de’HoFoo platform does not take any responsibility in case of such occurrences.
You/user/Foodie must cancel your order before ‘Order Closing Time’. de’HoFoo will refund or re-credit your debit or credit card or net banking account with the full amount within 3 to 7 Working Days, if cancellation was done within the specified terms and conditions. After ‘Order Closing Time’, usually Home Chef start cooking food. So order cancellation will not be accepted.
Order cancellation from Home Chef is not permissible. If home chef is publishing, it is considered that home chef is ready to deliver food. If home chef is not ready to prepare food, home chef should not publish the food.
If after publishing food, home chef realizes to unable prepare food, home chef should immediately unpublished the food, before getting any order.
The user understands and acknowledges that by choosing de’HoFoo you have allowed de’HoFoo to use your personal information.
The user understands, acknowledges and agrees that although de’HoFoo provides appropriate firewalls and protections, the de’HoFoo Service is not hack proof. Data pilferage due to unauthorized hacking, virus attacks, technical issues is possible.
In case de’HoFoo is required to disclose your personal information in order to assist the Government Authority or in adherence to a Court Order or to protect the interest of the de’HoFoo Service and/or any particular user(s), de’HoFoo will disclose it without obtaining prior permission from you. You, thus, in such circumstances have authorized us to disclose your personal information.
All intellectual property rights of the de’HoFoo, including but not limited to copyright, logos, names, trademarks, service marks, design, text, sound recordings, images, links, concepts and themes are exclusively owned by JISHNEM Innovations Private Limited. Any reproduction, transmission, publication, performance, broadcast, alteration, license, hyperlink, creation of derivative works or other use in whole or in part in any manner is strictly prohibited.
All claims and disputes arising under or relating to these terms and conditions are to be settled by binding arbitration between the parties. All legal conflicts and matters will have to be submitted in the court of law falling under the Jurisdiction of Pune, Maharashtra, India.
de’HoFoo takes complaints very seriously and aims to respond to your complaint as soon as possible.

On acceptance of above said terms, de’HoFoo grants you a personal, limited, non-exclusive and non-transferable license to access and use the Services only as expressly permitted in these Terms & Conditions. You shall not use the Services for any illegal purpose or in any manner inconsistent with these Terms. You may use information made available through the Services solely for your personal, non- commercial use. You agree not to use, copy, display, distribute, modify, broadcast, translate, reproduce, reformat, incorporate into advertisements and other works, sell, promote, create derivative works, or in any way exploit or allow others to exploit any of content in whole or in part except as expressly authorized by JISHNEM Innovations Private Limited. Except as otherwise expressly granted to you in writing, we do not grant you any other express or implied right or license to the Services, Content or our IP Rights. Any violation by you of the license provisions contained in this Section may result in the immediate termination of your right to use the Services, as well as potential liability for copyright and other IP Rights infringement depending on the circumstances.
You acknowledge and agree that if de’HoFoo disables access to your account, you may be prevented from accessing the Services, your account details or any files or other content, which is contained in your account.
We may, in our discretion and without liability to you, with or without cause, with or without prior notice and at any time terminate or suspend your access to our Application and Services.
